Power of amendment.
The Township Supervisors may from time to time amend, supplement, change, modify, or repeal this chapter including the Zoning Map, by proceeding in the manner prescribed in this article.
Public hearing and notice.
A. The Township Supervisors, by resolution adopted at a stated meeting or special meeting, shall fix the time and place of a public hearing on the proposed change, amendment, or repeal, and cause notice thereof to be given as follows:
(1) By publishing a notice thereof once each week for two successive weeks, the first being not more than 30 days prior, and the second not less than seven days prior, to the public meeting, and such notice shall appear in a newspaper of general circulation in Schuylkill Township;
(2) The notice shall state the general nature of the proposed change, amendment, or repeal and need not be a verbatim copy.
B. Full opportunity to be heard will be given to any Township citizen and all parties in interest attending such hearing.
Citizen's petition.
Whenever the owners of 51% or more of the area in any district shall present to the Township Supervisors a petition, duly signed and acknowledged, requesting an amendment, supplement, change, modification, or repeal of any of the regulations or restrictions prescribed by this chapter for their district, it shall be the duty of the Township Supervisors to hold a public hearing thereon and cause notice thereof to be given in the manner prescribed in the Public hearing and notice section, above.
Citizen's protest.
In case of a protest against any proposed amendment, change, modification or repeal, duly signed by the owners of 20% or more, either of the lots included in such proposed changes, or of those immediately adjacent in the rear, or in the front, or to either side thereof, extending 100 feet therefrom, such amendment shall not become effective except by favorable vote of a majority of the Township Supervisors.
Planning Commission referral.
The Township Supervisors shall refer each petition or proposal for change or amendment, whether under this article or under another article, to the Schuylkill Township Planning Commission and the Chester County Planning Commission. The Township Planning Commission and the Chester County Planning Commission shall transmit its conclusion thereon, together with its reasons therefor, to the Township Supervisors. The Township Supervisors shall take such conclusion and reasons into consideration in reaching its decision, but shall not be bound thereby. Such referrals shall be made not less than 30 days prior to the hearing for adoption by the Township Supervisors.
Curative amendment.
The foregoing procedures for amendments to this chapter to the contrary notwithstanding, the procedure upon curative amendments shall be in strict accordance with Section 609.1 of Act No. 93 of 1972 of the General Assembly, this being an amendment to the Pennsylvania Municipalities Planning Code, Act 247, which become effective January 1, 1969.
